Mone appealing the nonresponse of the Suffolk County District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 8, 2021, Attorney Mone requested the following records: [1] The number of cases reported to the Suffolk County District Attorney in the last two (2) years of assault and battery and/or assault and battery with a dangerous weapon, including the race and gender of the accused and the complaining witness; [2] The number of cases charged in Suffolk County in the last two (2) years of assault and battery and/or assault and battery with a dangerous weapon, including the race and gender of the accused and the complaining witness; [3] Any and all written policies by the Suffolk County District Attorney in effect during the last two (2) years concerning the charging of assault and battery and/or assault and battery with a dangerous weapon; [4] Any statistical compilations, reports or studies done by the Suffolk County District Attorney’s Office concerning selective prosecution based on race and/or gender identity in the past two (2) years. Claiming to not yet have received responsive records, Attorney Mone petitioned this office and this appeal, SPR21/0492, was opened as a result.
