Records Access Officer Massachusetts Bay Transportation Authority 10 Park Plaza Suite #7760 Boston, MA 02116 Dear Attorney Ciollo: I have received the petition of Patricia Lawrence appealing the response of the Massachusetts Bay Transportation Authority (MTBA) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 26, 2021, Ms. Lawrence requested “…a study that was performed regarding ground vibration/energy from the MBTA layover in Newburyport(source VHB, July 26, 2019, project #13257.18)” and “…diary information that was filled out by the contract engineer at…” an identified address. The MTBA provided a response which included a responsive record. Unsatisfied with the response, Ms. Lawrence petitioned this office and this appeal, SPR21/0494, was opened as a result. Subsequently, I learned that the Department responded to Ms. Lawrence’s request with a further response sent on March 10, 2021. Whereas the basis of this appeal was opened as a result of the Department’s January 27, 2021, response I will now consider this administrative appeal closed. Ms. Lawrence may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
