General Counsel Barnstable Sheriff’s Office 6000 Sheriff's Place, Bourne, MA 02532 Dear Attorney Buckley: I have received the petition of Matthew Rocheleau of the Boston Globe appealing the response of the Barnstable Sheriff’s Office (Office) to his request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On January 11, 2021, Mr. Rocheleau requested, “[a]ny/all disclosures of immediate family working in Massachusetts state government that were made by individuals who applied for employment with the Barnstable Sheriff's Office between Jan. 1, 2015 and present.” The Office responded on January 21, 2021. Unsatisfied with the response, Mr. Rocheleau appealed and SPR21/0511 was opened as a result. Based upon an email dated March 4, 4021, it is my understanding that the Office intends on providing a subsequent response to Mr. Rocheleau. Accordingly, the Office is ordered to provide Mr. Rocheleau with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of the Office's response within ninety days.
