Assistant District Attorney Middlesex District Attorney’s Office 15 Commonwealth Avenue Woburn, MA 01801 Dear Attorney DeBlander: I have received the petition of Jack Hembrough appealing the response of the Middlesex District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 6, 2021, Mr. Hembrough requested “[m]otor [v]ehicle [c]rash [r]eport 0942/ 18 Aug 20.” The Office responded on January 27, 2021, indicating it is withholding the requested record pursuant to Exemption (f). G. L. c. 4, § 7(26)(f). Unsatisfied with the response, Mr. Hembrough petitioned this office and this appeal, SPR21/0513, was opened as a result. It is my understanding that the Office intends on providing a subsequent response to Mr. Hembrough. Accordingly, the Office is ordered to provide Mr. Hembrough with a response to his request, in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Hembrough may appeal the substantive nature of the Office’s response within ninety days.
