Ryder Chief of Police Boxborough Police Department 520 Massachusetts Avenue Boxborough, MA 01719 Dear Chief Ryder: I have received the petition of Stanley Mazurczyk appealing the response of the Boxborough Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 26, 2021, Mr. Mazurczyk requested a copy or inspection of three categories of records: “1. Each standard electronically, preferably PDF format, you used to guide you in conducting reaccreditation. 2. Records produced to affirm re-accreditation of the Department. 3. Records that allow Boxborough to examine/scrutinize personal records protected by the Public Records Law.” The Department responded on March 1, 2021, and March 2, 2021, indicating that it has no records responsive to the request. Unsatisfied with the Department’s responses, Mr. Mazurczyk petitioned this office and appeal, SPR21/0525 was opened as a result. It is my understanding that the Department intends on providing a response to Mr. Mazurczyk. Accordingly, the Department is ordered to provide Mr. Mazurczyk with a response to his request, in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Mazurczyk may appeal the substantive nature of the Department’s response within ninety days.
