Assistant General Counsel Executive Office of Public Safety and Security One Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Matthew Rocheleau of the Boston Globe appealing the response of the Executive Office of Public Safety and Security (EOPSS), the Department of Criminal Justice Information Services (DCJIS), and the Department of State Police (Department) (hereinafter referred to as the Agencies or Departments) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rocheleau requested records pertaining to license plate reader (LPR) technology, including “[a]ny/all lists, inventory records, and/or maps of ALPR cameras/readers, including but limited to fix, mobile, portable, trailer- mounted, cruiser or vehicle-mounted devices, that the department owns or has access to, including but not limited to records showing the cameras’ locations.” Previous appeals and determinations This request was the subject of previous appeals. See SPR19/1092 Determination of the Supervisor of Records (June 11, 2019); SPR19/1713 Determination of the Supervisor of Records (September 9, 2019); SPR19/2249 Determination of the Supervisor of Records (November 20, 2019); SPR19/2249 Determination of the Supervisor of Records in camera (April 3, 2020); SPR20/1341Determination of the Supervisor of Records (August 24, 2020). In my August 24th determination, I indicated that it remained unclear why the Agencies cannot provide segregable portions of the records that do not reveal exempt information. The Agencies were ordered to provide Mr. Rocheleau with a response in a manner consistent with the order, the Public Records Law and its Regulations. The Agencies provided a response on March 4, 2021, which included a responsive record. Unsatisfied with the Agencies’ response, Mr. Rocheleau petitioned this office, and SPR21/0542 was opened as a result. SPR21/0542 Page 2 March 19, 2021 Conclusion Subsequent to the opening of this appeal, it is my understanding the Agencies intend on providing a supplemental response to Mr. Rocheleau. Accordingly, the Agencies are ordered to provide Mr. Rocheleau with a response, in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of the Agencies’ response within ninety days.
