Murray Supervisor of Records March 15, 2021 SPR21/0543 Mark Saloio Chief of Police Tisbury Police Department 32 Water Street Vineyard Haven, MA 02568 Dear Chief Saloio: I have received the petition of Rich Saltzberg of Martha’s Vineyard Times appealing the response of the Tisbury Police Department (Department) to a request for public records. G. L. c. 66, § l0A; see also 950 C.M.R. 32.08(1). On October 5, 2020, Mr. Saltzberg requested “all internal investigation reports or other internal investigation documentation generated between 2009 and 2014 that are focused on [an identified] … former officer in the Tisbury Police Department related to an incident that occurred at [a named address] on July 23, 2011.” Previous Appeal This request was the subject of a previous appeal. See SPR20/2244 Determination of the Supervisor of Records (December 2, 2020). The Department responded on March 1, 2021. Unsatisfied with the March 1st response, Mr. Saltzberg appealed, and SPR21/0543 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Saltzberg to address his concerns. Accordingly, the Department is ordered to provide Mr. Saltzberg with a response to his request, in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Saltzberg may appeal the substantive nature of the Department’s response within ninety days.
