Director of Public Records Record Access Officer City of Boston 1 City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Carlo Cellai, Esq. of Cellai Law Offices, P.C. appealing the nonresponse of the City of Boston (City) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 8, 2021, Attorney Cellai requested the following records: • “Any and all payment and/or performance bonds by, for, on behalf of and/or for the benefit of S & R Corporation for work at the project. • Any and all payment and/or performance bonds by, for, on behalf of and/or for the benefit of any contractor on the Project for work performed and/or to be performed by S & R Corporation on the Project. • Any and all general contracts in which were signed and/or performed (in whole and/or in part) with S & R Corporation. If S & R Corporation was not the general contractor, please send a copy of the general contract with the general contractor for whom S & R Corporation performed work on the Project. • Any and all documents referring to, relating to and/or referencing any and all payment and/or performance bonds for all contracts related to the public records request in the preceding paragraph. • Any and all documents referring to, relating to and/or referencing any Bonding information of S & R Corporation, A & S Corporation and/or anyone else on its behalf for construction work and/or materials provided to the above mentioned project. • Any and all documents relating to Massachusetts General Laws Chapter 149, Section 29, which refer to, relate to, and/or reference the above reference project which would allow Northeast Recycling Co., LLC to ascertain the bond company for which they can assert a bond claim for the removal of waste and recycled material provided to the City of Boston for the Project.” One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Shawn Williams, Esq. SPR21/0546 Page 2 March 19, 2021 Claiming to not yet have received a response, Attorney Cellai petitioned this office and SPR/0546, was opened as a result. Despite being notified of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the City has provided a response. Accordingly, the City is ordered to provide Attorney Cellai with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Cellai may appeal the substantive nature of the City’s response within ninety days.
