Murray Supervisor of Records March 18, 2021 SPR21/0551 Araceli Avila Ging Records Access Officer Division of Professional Licensure 1000 Washington Street Boston, MA 02118 Dear Ms. Avila Ging: I have received the petition of Elizabeth Garthe appealing the response of the Division of Professional Licensure (Division) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 10, 2021, Ms. Garthe requested numerous documents from the Division. Previous appeal This request was the subject of a previous appeal. See SPR21/0445 Determination of the Supervisor of Records (March 5, 2021). The Division provided a response on February 19, 2021. Unsatisfied with the Division’s response, Ms. Garthe appealed, and SPR21/0551 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a Division representative, it is my understanding that the Division intends on providing a subsequent response to Ms. Garthe to address her concerns. Accordingly, the Division is ordered to provide Ms. Garthe with a response to her request, in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Garthe may appeal the substantive nature of the Division’s response within ninety days.
