Staff Legal Counsel Office of Chief Legal Counsel Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Serra: I have received the petition of Joseph Catanese appealing the nonresponse of the Massachusetts Department of State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 3, 2020, Mr. Catanese requested “...any and all arrest or investigative reports including names of the troopers involved regarding a search conducted [at an identified address] on December 4, 2019.” Conclusion Subsequent to the intervention by a staff member of the Public Records Division, I learned that the Department provided Mr. Catanese a response. In an email dated March 11, 2021, the Department states, “[p]lease be advised the Department responded to this request on February 11, 2020, however, upon review, it appears that response was sent to the wrong email address. I have attached a copy of that response here.” In light of the Department’s March 11th letter, I will now consider this administrative appeal closed. Mr. Catanese may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
