Hogberg Office of the Chief Medical Examiner 720 Albany Street Boston, MA 02118-2518 Dear Eric B. Hogberg: I have received the petition of Colman Herman appealing the nonresponse of the Office of the Chief Medical Examiner (Office) to his requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Herman requested “hard copies and electronic copies of any and all communications related to…funeral workers getting the COVID-19 vaccine.” Claiming to not yet have received a response, Mr. Herman petitioned this office and this appeal was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Office has provided a response. As such, the Office is ordered to provide Mr. Herman with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the Office’s response within ninety days.
