Murray Supervisor of Records March 23, 2021 SPR21/0577 Priya Tahiliani Superintendent Everett Public Schools 121 Vine Street Everett, MA 02149 Dear Superintendent Tahiliani: I have received the petition of Steven Fitzgerald appealing the response of the Everett Public Schools (School) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 11, 2020, Mr. Fitzgerald requested, .. Any and all reports … pertaining to the Sexual Harassment payout of $1,322,832.00 made by the Professional Governmental Underwriters, Inc., on policy # … for the Everett School Committee on November 21, 2018 claim Number …[including] date and time when this matter was reported to any member of the Everett Public Schools, Everett School Department, and Everett Public School Committee. This request should also include the names and titles of who the reports were made to [and] include dates and times that this matter was reported to the Everett Police Department and/or Middlesex County District Attorney’s Office if reports were made. This request should also include the names and titles of the reporting person whether the victim or not. Included in this request is the dates in which this matter may have been discussed in School Committee Meetings, whether it a regular or executive session. Also, included in this request is all members of the School Department, School Committee, or City of Everett who were present for these discussions. Also included in this request is any communications sent or received to the City of Everett and/or Mayor … on this matter and … include the position or title of the accused.” Prior appeal The requested records were the subject of a prior appeal. See SPR21/0054 Determination of the Supervisor of Records (January 22, 2021). In my January 22nd determination, I learned the School was aware of the request and that the School would provide a supplemental response. Accordingly, I ordered the School to provide a response to the request. Priya Tahiliani SPR21/0577 Page 2 March 23, 2021 February 3rd. Unsatisfied with the City’s response, Mr. Fitzgerald appealed and SPR21/0577 was opened as a result. Subsequent to the intervention by a staff attorney of the Public Records Division, I learned that the Town responded to Mr. Fitzgerald’s request with a response sent on March 9, 2021. Whereas the basis of this appeal was opened as a result of the Town’s February 3rd response, I will now consider this administrative appeal closed.
