McDonnell: I have received the petition of Ben Berke of The Public's Radio appealing the response of the Quincy Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 1, 2021, Mr. Berke requested “[a]ll video requests made by the Quincy Police Department through the Neighbors App in 2020.” The Department responded on February 16, 2021, stating “that the Quincy Police Department has no responsive records to [Mr. Berke’s] request as such records are hosted on Ring’s Cloud server and not in the Department’s records system.” Unsatisfied with the Department’s response, Mr. Berke appealed, and this case was opened as a result. In an email on March 25, 2021, a representative of the Department provided Mr. Berke with records responsive to his request. Conclusion In light of the supplemental response provided by the Department, I will now consider this administrative appeal closed. Mr. Berke may further appeal the substantive nature of the Department’s supplemental response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
