Withers City Clerk City of Attleboro 77 Park Street Attleboro, MA 02703 Dear Mr. Withers: I have received the petition of Colman Herman appealing the response of the City of Attleboro (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 3, 2021, Mr. Herman requested: “… copy of the message cited on social media [involving] wife of a firefighter criticized the mayor…” Previous appeals This request was the subject of previous appeals. See SPR21/0006 Determination of the Supervisor of Records (January 19, 2021); SPR21/0128 Determination of the Supervisor of Records (February 19, 2021). The City responded on March 5, 2021. Unsatisfied with the City’s response, Mr. Herman appealed and SPR21/0621 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response. Accordingly, the City is ordered to provide Mr. Herman with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the City's response within ninety days.
