Board of Registration in Medicine 200 Harvard Mill Square, Suite 330 Wakefield, MA 01880 Dear Attorney Douglas: I have received the petition of Dr. Bharani Padmanabhan appealing the nonresponse of the Board of Registration in Medicine (Board) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Dr. Padmanabhan submitted a request for the “board profile” for a certain individual, “as well as… records of any complaints, notices from [the] Superior Court as well as all court documents regarding any allegation of malpractice, and any and all [Board] documents pertaining to a statement of allegations, Final Decision, Consent Order, etc.” within the possession of the Board. Claiming to not yet have received a response, Dr. Padmanabhan petitioned this office and this appeal was opened as a result. Subsequent to the intervention by a staff member of the Public Records Division, I learned that a representative from the Board intends on providing a written response to Dr. Padmanabhan to his respective request. Accordingly, the Board is ordered to provide Dr. Padmanabhan with a response made in accordance with the Public Records Law, its Access Regulations and this order within 10 business days. It is preferable to send an electronic copy of the response to this to this office at pre@sec.state.ma.us. Dr. Padmanabhan may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
