Murray Supervisor of Records March 29, 2021 SPR21/0625 Diane Crory Town Clerk/Records Access Officer Town of Littleton 37 Shattuck Street Littleton, MA 01460 Dear Ms. Crory: I have received the petition of Christine Nordhaus appealing the response of Town of Littleton (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Ms. Nordhaus requested certain messages exchanged between the dates of January 1, 2016 through the present. On March 12, 2021, the Town provided a response that the request was received, but, stated, “[d]ue to the COVID 19 pandemic and preparation for the upcoming Annual Town Meeting, the Town’s limited resources are already being stretched. Replying to this request within 10 business days of receipt would burden the other responsibilities of the Town. Accordingly, the Town will respond to your request within the next 15 business days, as permitted by [G. L. c. 66, §10(b)(vi).” As a result, Ms. Nordhaus petitioned the Supervisor of Records (Supervisor), and this appeal was opened. In response to this appeal, an attorney in the Public Records Division was informed by the Town’s Legal Counsel, Thomas J. Harrington of Miyares Harrington, LLP that on March 26, 2021, the Town provided certain of the records responsive to Ms. Nordhaus’s request, and is currently working to provide further records responsive to the request. Conclusion Where this appeal was based on the March 12th response and the Town has subsequently provided an additional response, I will consider this appeal closed. Ms. Nordhaus may appeal the substantive nature of the subsequent response within 90 days. See 950 C.M.R. 32.08(1).
