Hucksam Jr., Esq. City of Lowell – Law Department 375 Merrimack Street 3rd Floor Lowell, MA 01852 Dear Attorney Hucksam: I have received the petition of Kevin J. Goscila appealing the nonresponse of the City of Lowell Office of the City Solicitor (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 5, 2021, Mr. Goscila requested “…all use of force policies and/or use of defensive tactics policies in use from January 1, 2019 until March 5, 2021.” Claiming to not yet have received responsive records, Mr. Goscila petitioned this office and this appeal, SPR21/0735, was opened as a result. It is my understanding the Town responded on April 7, 2021. In light of the correspondence, I will consider this administrative appeal closed. If issues remain unresolved, Mr. Goscila may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
