Murray Supervisor of Records April 12, 2021 SPR21/0782 Greg Lucey, City Clerk Records Access Officer City of Malden 215 Pleasant Street Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Bruce Friedman appealing the response of City of Malden (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 6, 2021, Mr. Friedman requested records pertaining to email service payments and public records requests made to the City from 2016 through the date of response. Previous appeals This request was the subject of previous appeal. See SPR21/0488; SPR21/0489 Determination of the Supervisor of Records (March 11, 2021); SPR21/0598 Determination of the Supervisor of Records (March 25, 2021). Unsatisfied with the City’s March 24th response, Mr. Friedman appealed and SPR21/0782 was opened as a result. Current Appeal In his current appeal Mr. Friedman indicates that the City did not provide all responsive records. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Friedman. Accordingly, the City is ordered to provide Mr. Friedman with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Friedman may appeal the substantive nature of the City's response within ninety days. See 950 C.M.R. 32.08(1).
