Murray Supervisor of Records April 12, 2021 SPR21/0787 Greg Lucey, City Clerk Records Access Officer City of Malden 215 Pleasant Street Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Bruce Friedman appealing the response of City of Malden (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 6, 2021, Mr. Friedman requested “…all email delegation permissions and/or send/receive permissions on behalf of any member of the Mayor’s office and/or administration, and any member of the City Council including the clerk, where the said person is afforded permissions and/or any person subject of said permissions. Please provide the delegations themselves, the dates for the delegations, the person who setup the delegations, and the specific email accounts involved. This request is for the timeframe January 1, 2017 through the date you answer this request including deleted delegations.” On March 24, 2021, the City responded. Unsatisfied with the response, Mr. Friedman petitioned this office and SPR21/0787 was opened as result. Current Appeal In his current appeal Mr. Friedman indicates that the City did not provide all responsive records. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Mr. Friedman. Accordingly, the City is ordered to provide Mr. Friedman with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days.
