Murray Supervisor of Records April 14, 2021 SPR21/0814 Aaron Wojtkowski Detective Sergeant Newbury Police Department 25 High Road Newbury, MA 01951 Dear Detective Sergeant Wojtkowski: I have received the petition of Elizabeth Malone appealing the response of the Newbury Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 2, 2020, Ms. Malone requested the following: “Newbury Police Department Summons [identified] Report.” Prior Appeal This request was the subject of a prior appeal. See SPR21/0495 Determination of Supervisor of Public Records (March 11, 2021). In the March 11th determination, I found that the Department had not met its burden under Exemption (c). On March 20, 2021, the Department provided a supplemental response. Unsatisfied with the response, Ms. Malone petitioned this office and SPR21/0814 was opened as a result. Subsequently, I learned that the Department provided a further response to Ms. Malone on April 13, 2021. Where the basis of this appeal was opened as a result of the Department’s March 20th response, I will now consider this administrative appeal closed. Ms. Malone may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
