Murray Supervisor of Records April 8, 2021 SPR21/0859 Greg Lucey City Clerk City of Malden 10 Pleasant Street, First Floor Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Mary Schwager of WHDH-TV appealing the nonresponse of the City of Malden (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 18, 2021, Ms. Schwager requested “[a]ll 911 calls, radio transmissions, interagency calls (police, fire and ambulance) and run sheets from 11pm on 2/27/21 to 2am on 2/28/21… [a]ny subsequent fire department investigations, memos, or inquiries into events that transpired on 2/27/21 and 2/28/21.” Claiming to not yet have received a response, Ms. Schwager petitioned this office and this appeal was opened as a result. Subsequently, I learned that the City provided Ms. Schwager with a response to her request dated April 8, 2021. Whereas the basis of the appeal was opened as a result of the City’s lack of response to Ms. Schwager’s request, I will now consider this administrative appeal closed. Ms. Schwager may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
