Murray Supervisor of Records April 20, 2021 SPR21/0864 Celine Gettings City of Lowell 375 Merrimack Street, 3rd Floor Lowell, MA 01852 Dear Ms. Gettings: I have received the petition of Mr. Anthony Barry appealing the nonresponse of the City of Lowell (City) to her request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 15, 2021, Mr. Barry requested “[a]ny and all documents, including but not limited to arrest reports…” related to two named individuals. Claiming to not yet have received a response, Mr. Barry petitioned this office and this appeal was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the City has provided a response. As such, the City is ordered to provide Mr. Barry with a written response. Said response must be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Barry may appeal the substantive nature of the City’s response within ninety days.
