Legal Counsel Executive Office of Public Safety & Security One Ashburton Place, Room 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Jim Haddadin of NBC10 Boston appealing the nonresponse of the Executive Office of Public Safety & Security (Office) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 24, 2021, Mr. Haddadin requested the following records for the calendar year 2020: • ”All Death[s] in Custody Reporting Act reports (Form DCR-1A) submitted to the Executive Office of Public Safety • Any data submitted pursuant to the Death in Custody Reporting Act to the U.S. Department of Justice Bureau of Justice Assistance via quarterly summaries…” Claiming to not yet have received a response, Mr. Haddadin petitioned this office and SPR21/0929 was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Office has provided a response. As such, the Office is ordered to provide Mr. Haddadin with a written response. Said response shall be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Haddadin may appeal the substantive nature of the Office’s response within ninety days.
