Berkshire District Attorney’s Office 7 North Street Pittsfield, MA 01201 Dear Attorney Dohoney: I have received the petition of Buffy Lord, Esq. appealing the response of the Berkshire District Attorney’s Office (Office) to a request for public records. G. L. c. 66, §10A; see also 950 C.M.R. 32.08(1). On April 6, 2021, Attorney Lord requested “Massachusetts State Police Report, including any accident reconstruction report, relating to a collision that occurred on October 20, 2019 on Route 8 in Cheshire and involving vehicles operated by [named persons].” On April 14, 2021, the Office responded. Unsatisfied with the response, Attorney Lord appealed and SPR21/0951 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a subsequent response to Attorney Lord. Accordingly, the Office is ordered to provide Attorney Lord with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Lord may appeal the substantive nature of the Office's response within ninety days.
