Lampke of LampkeLaw, LLC appealing the nonresponse of the Boston Water and Sewer Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 2, 2021, Attorney Lampke requested twelve (12) categories of records “… evidencing, describing, pertaining or relating to a water main break that occurred on April 14-15, 2020 at the intersection of [named streets] in Boston’s South End neighborhood.” Claiming to not yet have received responsive records, Attorney Lampke petitioned this office and SPR21/1009, was opened as a result. Based on communication between a Public Records Division staff member and a Commission representative, I learned that the Commission provided the first set of responsive records on April 28th and intends to provide the remaining records on a rolling basis. Accordingly, I will consider this administrative appeal closed. Attorney Lampke may appeal the substantive nature of the Commission’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
