Murray Supervisor of Records May 4, 2021 SPR21/1025 Robert Baronoski Town of East Brookfield Conservation Commission 122 Connie Mack Drive East Brookfield, MA 01515 Dear Mr. Baronoski: I have received the petition of Attorney David A. Wojcik of Christopher, Hays, Wojcik & Mavricos, LLP appealing the response of the Town of East Brookfield Conservation Commission (Commission) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 2, 2021, Attorney Wojcik requested the following records for the time period January 1, 2001 through the present: “1) All enforcement orders issued by the Commission or any of its members, officers or employees … 2) All minutes of the Commission … 3) All records of the Commission with respect to the annual draw downs of Lake Lashaway including but not limited to all orders of condition and all documents setting forth or relating or referring to the purposes of said annual draw downs and all records which reference the Lake Lashaway draw downs in any manner. 4) All permits, approvals, orders of condition, or other records of any nature, which reference, relate to or refer to any beach or lake front clean up with respect to any properties with lake frontage on Lake Lashaway …” Claiming to not yet have received responsive records, Attorney Wojcik petitioned this office and SPR21/1025 was opened as a result. As such, the Commission is ordered to provide Attorney Wojcik with a response to his request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us.
