Assistant General Counsel Executive Office of Public Safety and Security One Ashburton Place, Suite 2133 Boston, MA 02108 Dear Attorney Mullaney: I have received the petition of Matthew Rocheleau of the Boston Globe appealing the response of the Executive Office of Public Safety and Security (EOPPS) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rocheleau requested: “(1) [a]ny/all e-mails sent [by an identified employee] to one or more email address[es] ending in either @state.ma.us; @massmail.state.ma.us; @doc.state.ma.us, or @mcofu.org from and including January 10, 2020, to, and including March 31, 2020; and (2) [a]ny/all emails [an identified employee] received from one or more email address[es] ending in either @state.ma.us; @massmail.state.ma.us; @doc.state.ma.us, or @mcofu.org from and including January 10, 2020, to, and including March 31, 2020.” EOPPS provided a fee estimate for responding to this request. Subsequently, Mr. Rocheleau narrowed his request. Mr. Rocheleau then provided EOPPS with a check for $900.50 and the check was cashed on April 1st. To date, the requested records have not been provided. Based upon a conversation between a Senior Attorney in the Public Records Division and Attorney Mullaney, it is my understanding that EOPPS intends to provide a subsequent response to Mr. Rocheleau to advise him on the status of the review of the records, and a timeline for providing him with the responsive records. I encourage the parties to continue to communicate to produce records efficiently.
