Silvia Department of Correction, Legal Division 50 Maple Street Milford, MA 01757 Dear Kate Silvia: I have received the petitions of Matthew Rocheleau appealing the nonresponse of the Massachusetts Department of Correction (Department) to his requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Rocheleau requested records relating to identified people, documents, reports, and communications. Claiming to not yet have received a response, Mr. Napolitano petitioned this office and these appeals were opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Department has provided a response. As such, the City is ordered to provide Mr. Rocheleau with a written response. Said response must be made in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Rocheleau may appeal the substantive nature of the Department’s response within ninety days.
