Legal Counsel Department of State Police Crime Lab 124 Acton Street Maynard, MA 01754 Dear Attorney Miller: I have received the petition of Jennifer A. Denker, Esq. of Meehan, Boyle, Black and Bogdanow PC appealing the response of the Department of State Police Crime Lab (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On February 1, 2021, Attorney Denker requested the file of an identified person. The Department responded on February 12, 2021. Unsatisfied with the Department’s response, Attorney Denker petitioned this office and SPR21/1047 was opened as a result. Based upon a communication between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Attorney Denker. Accordingly, the Department is ordered to provide Attorney Denker with a response to her request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Attorney Denker may appeal the substantive nature of the Department's response within ninety days.
