Murray Supervisor of Records May 10, 2021 SPR21/1057 Greg Lucey City Clerk City of Malden 110 Pleasant Street, First Floor Malden, MA 02148 Dear Mr. Lucey: I have received the petition of Malden Transparency appealing the response of the City of Malden (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 24, 2021, Malden Transparency requested numerous email correspondence. Prior Appeal This appeal was subject to a prior determination. See SPR21/0913 Determination of the Supervisor of Public Records (April 22, 2021). In my April 22nd determination I ordered that the City provide Malden Transparency with a response. On April 22nd the City provided a response. Unsatisfied with the response, Malden Transparency appealed and SPR21/1057 was opened a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Malden Transparency. Accordingly, the City is ordered to provide Malden Transparency with a response to the request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Malden Transparency may appeal the substantive nature of the City's response within ninety days. See 950 C.M.R. 32.08(1).
