Box 455 3231 Main Street Barnstable, MA 02630 Dear Attorney Miltimore: I have received the petition of Rich Saltzberg of the Martha Vineyard’s Times appealing the nonresponse of the Cape & Islands District Attorney’s Office (Office) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 6, 2021, Mr. Saltzberg requested “…any and all logs, ledgers, spreadsheets, or other documentation used to record the destruction or disposal of Tisbury Police records relevant to prosecutions or investigations by the Cape and Islands District Attorney’s Office between Jan 1, 2011 and March 1, 2021.” Conclusion Subsequent to the intervention by a staff member of the Public Record’s Division, I learned that the Office provided Mr. Saltzberg a response dated May 5, 2021. In light of the Office’s May 5th letter, I will now consider this administrative appeal closed. Mr. Saltzberg may appeal the substantive nature of the Office’s response within ninety days.
