G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 17, 2021 Mr. Shibley requested “records in the Department’s possession related to the alleged suspended search and/or hiring of a fifth trooper to the Unresolved Case(s) Unit, to include: All related emails” between a number of specific personnel. On April 7, 2021, following email discussion with the Department about a fee estimate, Mr. Shibley clarified the search parameters of his request. Having received no further response, Mr. Shibley appealed and this case was opened as a result. Subsequently, I learned that the Department intends to provide a written response. In an email to this office on May 3, 2021, the Department confirmed it is “working on providing a response to Mr. Shibley related to this appeal.” Accordingly, the Department is ordered to provide Mr. Shibley with a response in accordance with the Public Records Law, its Access Regulations and this order within ten business days. It is preferable to send an electronic copy of the response to this office at pre@sec.state.ma.us. Mr. Shibley may appeal the substantive nature of the Department’s response within ninety days.
