Fenlon Assistant Chancellor for University Relations University of Massachusetts Boston 100 Morrissey Boulevard Boston, MA 02125 Dear Mr. Fenlon: I have received the petition of Colman Herman appealing the response of the University of Massachusetts Boston (University) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 10, 2021, Mr. Herman requested the following: “1) Records of all the expenses that [Chancellor] incurred in his capacity as chancellor of the University of Massachusetts Boston for the period July 1, 2020 to the present. This includes, but is not limited to, the following. a) Expense reports, including back-up receipts b) Credit cards statements, including back-up receipts c) Automobile expense records d) Any and all other records that document Chancellor [‘s] expenses 2) The written employee reimbursement policy of the University of Massachusetts Boston.” On April 26, 2021, the University responded. Unsatisfied with the University’s response, Mr. Herman petitioned this office and SPR21/1101 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and a University representative, it is my understanding that the University intends on providing a subsequent response to Mr. Herman. Accordingly, the University is ordered to provide Mr. Herman with a response to his request in a manner consistent with the Public Records Law and its Access Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the University’s response within ninety days. See 950 C.M.R. 32.08(1).
