The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records May 19, 2021 SPR21/1140 & SPR21/1144 Jennifer M. Staples, Esq. Office of the Chief Legal Counsel Department of State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petition of Freddy Cook appealing the nonresponse of the Department of State Police (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Cook submitted two identical requests to the Department Headquarters and the Charlton Barracks requesting certain records related a certain motor vehicle moving citation. Claiming to not yet have received a response, Mr. Cook petitioned this office and this appeal was opened as a result. Subsequent to the request for an appeal, I learned that the Department responded to Mr. Cook’s request with a response sent on May 17, 2021. Whereas the basis of these appeals were opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Mr. Cook may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Freddy Cook Christine M. Dowling, Esq.
