Box 466 Gardner, MA 01440 Dear Superintendent Divris: I have received the petition of Robert Cantell appealing the response of the Department of Correction – NCCI Gardner (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 7, 2021, Mr. Cantell requested “…all submitted, requested, approved, denied, and/or completed ‘request for mail monitor’ form(s)…particularly section 1. mail monitors, ‘1’ and ‘2’, ‘(a)’ through ‘(d)’; regarding either or both incoming and outgoing inmate mail, from July through December 2020 and January 2021.” Claiming to not yet have received responsive records, Mr. Cantell petitioned this office and this appeal, SPR21/1147, was opened as a result. It is my understanding a representative of the Department provided a response dated May 10, 2021 to Mr. Cantell. Accordingly, I will consider this administrative appeal closed. Mr. Cantell may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S.
