Record Access Officer Executive Office of Health and Human Services One Ashburton Place, 11th Floor Boston, MA 02108 Dear Attorney Scanlan: I have received the petition of Dan Atkinson appealing the response of the Executive Office of Health and Human Services (Office/EOHHS) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 16, 2021, Mr. Atkinson requested copies of three categories of records “…provided to EOHHS by McKinsey & Company…” The Office provided a response on May 3, 2021, which included a fee estimate. Unsatisfied with the Office’s response, Mr. Atkinson petitioned this office and SPR21/1159 was opened as a result. Based upon a conversation between a Public Records Division staff attorney and an Office representative, it is my understanding that the Office intends on providing a supplemental response to Mr. Atkinson. Accordingly, said response must be made in a manner consistent with the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Atkinson may appeal the substantive nature of the Office’s response within ninety days.
