General Counsel Alcoholic Beverages Control Commission 95 Fourth Street, Suite 3 Chelsea, Massachusetts 02150 Dear Attorney Foster: I have received the petition of Attorney Carlo Cellai appealing the response of the Alcoholic Beverages Control Commission (ABCC) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 6, 2021, Attorney Cellai requested “[a]ny and all rules, regulations, directives, policies, ordinances and/or by-laws which precludes any one property from obtaining more than one liquor license.” ABCC provided a response on May 6, 2021. Unsatisfied with ABCC’s response, Attorney Cellai petitioned this office and this appeal, SPR21/1160, was opened as a result. Subsequently, I learned on May 18, 2021 via email that the ABCC provided Attorney Cellai with a response on May 14, 2021. In light of this response, I will now consider this administrative appeal closed. Attorney Cellai may appeal the substantive nature of the ABCC’s May 14th response within ninety days.
