Murray Supervisor of Records May 12, 2021 SPR21/1164 Christopher Tisbert Records Access Officer Town of Brookline 333 Washington Street Brookline, MA 02445 Dear Mr. Tisbert: I have received the petition of Mike Offner appealing the response of the Town of Brookline (Town) to his request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Mr. Offner requested “[a]ny invoices, receipts, or other documents that [the Town] Moderator has received for the mailer sent to ‘friends and neighbors’, endorsing individual, per the image below, indicating the total amount that [the Town] Moderator spent on this mailer.” Previous appeal This request was the subject of a previous appeal. See SPR21/1041 Determination of the Supervisor of Records (May 6, 2021). SPR21/1041 was closed after this office was notified that the Town had provided a response on May 7, 2021. Unsatisfied with the Town’s response, Mr. Offner petitioned this office and this appeal, SPR21/1164, was opened as a result. The Town’s May 7th response On May 7, 2021, the Town emailed Mr. Offner stating, “[c]opies of the records that are responsive to your April 22, 2021 public record request in the custody of the Town are attached.” In his appeal petition on May, 7, 2021, Mr. Offner explained the “Town Clerk has produced no invoices, receipts, or other documents indicating the amount that Mr. Gadsby spent on this mailer.” Subsequently, I learned that the Town provided a further response in an email to Mr. Offner’s appeal on May 11, 2021. Where the basis of this appeal was opened as a result of the Town’s May 7th response, I will now consider this administrative appeal closed.
