G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On January 28, 2021, Mr. Grenier requested numerous documents concerning a missing person’s case from 1/18/2010 to present. Prior Appeal This appeal was the subject of a prior determination. See SPR21/0387 Determination of the Supervisor of Records (March 2, 2021). In my March 2nd determination, I found that the Department had not met its burden to withhold the requested records under the exemption described. I ordered that the Department provide Mr. Grenier with a response in accordance with the order, the Public Records Law and its Regulations. On March 16, 2021, the Department provided said response. Unsatisfied with the response, Mr. Grenier petitioned this office and this appeal, SPR21/1177, was opened as a result. Conclusion Based upon a conversation between a Public Records Division staff attorney and a Department representative, it is my understanding that the Department intends on providing a subsequent response to Mr. Grenier.
