Massachusetts State Police 470 Worcester Road Framingham, MA 01702 Dear Attorney Staples: I have received the petition of Craig Shibley appealing the nonresponse of the Massachusetts Department of State Police (Department) to his requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). Specifically, Mr. Shibley requested “all interview transcripts” associated with an identified individual. Claiming to not yet have received a response, Mr. Shibley petitioned this office and this appeal was opened as a result. Despite being notified of the opening of this appeal and communication from a staff member of the Public Records Division, it remains unclear whether the Department has provided a response. As such, the Department is ordered to provide Mr. Shibley with a written response. Said response must be made in accordance with the Public Records Law, its Access Regulations and this order within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Shibley may appeal the substantive nature of the Department’s response within ninety days.
