Executive Director Massachusetts Sheriffs’ Association 132 Portland Street, 2nd Floor Boston, Massachusetts 02114 Dear Attorney Hill: I have received the petition of Eliza Kaplan appealing the response of the Massachusetts Sheriffs’ Association (MSA) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On November 30, 2020, Ms. Kaplan requested “copies of any and all reports filed on behalf of the Massachusetts Sheriffs’ Association or its director with House and Senate Ways and Means Committees in 2020.” Previous appeal This request was the subject of a previous appeal. See SPR21/0438 Supervisor of Records Determination (March 4, 2021). In my March 4th determination, I found the MSA provided a supplemental response to Ms. Kaplan on March 2, 2021, indicating they were continuing to search for requested records. Claiming the MSA has failed to provide a response since March 2nd, Ms. Kaplan petitioned this office and appeal SPR21/1213 was opened as a result. Conclusion Subsequent to the opening of this appeal, the MSA provided a response on May 25, 2021, indicating they intend on providing a response to Ms. Kaplan. Accordingly, said response must be made in a manner consistent with the Public Records Law and its Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Kaplan may appeal the substantive nature of the MSA’s response within ninety (90) days.
