Murray Supervisor of Records June 4, 2021 SPR21/1253; SPR21/1254; SPR21/1255 Todd Palmer Super RAO City of Framingham 150 Concord Street Framingham, MA 01702 Dear Mr. Palmer: I have received the petition of Olufunmilola Shelly appealing the responses of the City of Framingham (City) to requests for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 28, 2021, Ms. Shelly made three separate requests for the following records: [1] [A]ll text messages on the city owned cell phone, or any private cell phone used to conduct city business, of any city councilor during the date range of 5/12/2020-5/14/2020 . . . when the other party is the mayor. [2] [A]ll text messages on any city or police owned cell phone between [] 5/12/2020-5/14/2020 . . . when the sender or recipient is the mayor. [3] [A]ll text messages on the city owned cell phone of [named persons] during the date range of 5/12/2020-5/14/2020.” On April 30, 2021, the City responded. Unsatisfied with the City’s responses, Ms. Shelly petitioned this office and SPR21/1253, SPR21/1254, and SPR21/1255 were opened as a result. Based upon a conversation between a Public Records Division staff attorney and a City representative, it is my understanding that the City intends on providing a subsequent response to Ms. Shelly to address her concerns. Accordingly, the City is ordered to provide Ms. Shelly with a response to her requests in a manner consistent with the Public Records Law and its Regulations within 10 business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Shelly may appeal the substantive nature of the City’s response within ninety days.
