The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 7, 2021 SPR21/1319 Ann Marie Gill Bridgewater Police Department 220 Pleasant Street Bridgewater, MA 02324 Dear Ms. Gill: I have received the petition of Mitchell Kosht, Esq. appealing the nonresponse of the Bridgewater Police Department (Department) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 8, 2021, Attorney Kosht requested the following records: 1. A spreadsheet, e.g., Microsoft Excel, or other flat file format, e.g., Comma-separated Values (CSV) or Tab-separated Values (TSV), containing the following fields of data for all personnel employed by the Chelsea Police Department: a) Employee Identification number b) Last Name c) First Name d) Badge number e) Rank f) Status (i.e, "active" or "suspended with pay") g) Date the individual joined the Chelsea Police Department 2. A spreadsheet identical to that generated in response to the first part of this request, with the same information as of as of January 1st of each year dating back to 2010. Claiming to not yet have received a response, Attorney Kosht petitioned this office and this appeal was opened as a result. Subsequent to the request for an appeal, I learned that the Department responded to Attorney Kosht’s request with a response sent on June 7, 2021. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Kosht may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
