G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 31, 2021, Attorney Cregor requested the following records: … copies of any materials prepared by or for the Boston University School of Social Work in connection with the report, Designing Data-Driven Directions for School Success of Children in Care, in your possession, including the data sets compiled by DESE and the Department of Children and Families (DCF) and any other data sets related to the report. ...copies of any analysis DESE has conducted on the educational outcomes of public school students ever in DCF custody, students in DCF custody at any point over the last 5 years, students currently in DCF custody, and/or any other related data set available for the 2017- 2018, 2018-2019, and 2019-2020 school years for [seven identified] topics ... Claiming to not yet have received a response, Attorney Cregor petitioned this office and SPR21/1325 was opened as a result. Subsequently, I learned that the Department responded to Attorney Cregor’s request with a response sent on June 4, 2021. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Attorney Cregor may appeal the substantive nature of the Department’s response within ninety days. See 950 C.M.R. 32.08(1).
