General Counsel Office of the Chief Medical Examiner Commonwealth of Massachusetts 720 Albany Street Boston, MA 02118 Dear Attorney Hogberg: I have received the petition of Patricia Alulema of Boston 25 News appealing the nonresponse of the Office of the Chief Medical Examiner (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 27, 2021, Ms. Alulema requested the following: “[1] All emails that were received and/or deleted from [named individual’s] state-issued computer, from November 1, 2020 to Present, relating to purchases made using her state email; [2] Emails sent to [named individual] from [named individual] between November 1, 2020 to present; [3] Copy of Office’s sexual harassment policy and policies related to gifts and gratuities.” Claiming to not yet have received responsive records, Ms. Alulema petitioned this office and this appeal, SPR21/1382, was opened as a result. Despite being notified of the opening of this appeal, it remains unclear whether the Office has provided a response. As such, the Office is ordered to provide Ms. Alulema with a response to this request, provided in a manner consistent with this order, the Public Records Law and its Access Regulations within ten (10) business days. A copy of any such response must be provided to this office. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Ms. Alulema may appeal the substantive nature of the Office’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
