Assistant General Counsel Department of Early Education and Care 51 Sleeper Street Fourth Floor Boston, MA 02210 Dear Attorney Karlin: I have received the petition of Patricia Alulema of Boston 25 News appealing the nonresponse of the Department of Early Education and Care (Department) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 2, 2021, Ms. Alulema requested the following: “[1] EEC investigation report and non-compliances for the fire that occurred on January 4 at the family daycare of [named individual], located at [named address]; [2] EEC investigation report and non-compliances related to two (2) separate alleged sexual assault incidents, occurred between November 2020 and January 2021, at Archway group home in Leicester.” Claiming to not yet have received responsive records, Ms. Alulema petitioned this office and this appeal, SPR21/1388, was opened as a result. Subsequently, the Department provided a response dated June 3, 2021 and a second response dated June 11, 2021 to Ms. Alulema’s request. Where the basis of this appeal was opened as a result of the Department’s lack of a written response, I will now consider this administrative appeal closed. Ms. Alulema may appeal the substantive nature of the Department’s response within ninety (90) days. See 950 C.M.R. 32.08(1).
