Box 1069 Pittsfield, MA 01201 Dear Attorney Dohoney: I have received the petition from Ledballoons 32 appealing the response of the Berkshire District Attorney’s Office (Office) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On April 19, 2021, the requestor sought to obtain the following records: “[1] List of docket numbers and case types for all cases for which [named individual] has entered an appearance, either as a defense attorney or prosecutor; [2] All transcripts of any proceedings in which [named individual] has an appearance.” Previous appeal This request was the subject of a previous appeal. See SPR21/1151 Determination of the Supervisor of Records (May 12, 2021). SPR21/1151 was closed after this office was notified that the Office provided a response on May 11, 2021. Unsatisfied with the Office’s May 11th response, the requestor petitioned this office and this appeal, SPR21/1389, was opened as a result. Subsequent to the opening of this appeal, the Office provided a supplemental response on June 16, 2021. Where the basis of this appeal was the May 11th response, I will consider this administrative appeal closed. If issues remain unresolved, the requestor may appeal the substantive nature of the Office’s June 16th response within 90 days. See 950 C.M.R. 32.08(1).
