Director of Public Records Records Access Officer City of Boston One City Hall Plaza, Room 615 Boston, MA 02201 Dear Attorney Williams: I have received the petition of Colman Herman appealing the nonresponse of the City of Boston (City) to a request for public records. See G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 15, 2021, Mr. Herman requested communications exchanged between identified individuals from May 1, 2021 to the present. Claiming to not yet have received responsive records, Mr. Herman petitioned this office and this appeal, SPR21/1401, was opened as a result. I learned that the proper agent for handling public record requests never saw the inquiry as it was sent to an incorrect address. The City has subsequently been provided with a copy of Mr. Herman’s request. Accordingly, the City is ordered to provide Mr. Herman with a response in accordance with this order, the Public Records Law and its Access Regulations within ten (10) business days. It is preferable to send an electronic copy of this response to this office at pre@sec.state.ma.us. Mr. Herman may appeal the substantive nature of the City’s response within ninety (90) days.
