Casper II Town Clerk Town of Marshfield 870 Moraine Street Marshfield, MA 02050 Dear Ms. Casper: I have received the petition of Joseph A. Pecevich appealing the response of the Town of Marshfield (Town) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On March 22, 2021, Mr. Pecevich requested elections related records. Previous Appeal This request was the subject of a previous appeal. See SPR21/1174 Supervisor of Records Determination (May 18, 2021). In my May 18th determination, I ordered the Town to clarify whether it was able to provide additional records responsive to Mr. Pecevich’s request. I also encouraged Mr. Pecevich and the Town to continue communicating to facilitate providing records more efficiently and affordably. Subsequently, counsel for the Town responded on June 3, 2021. Unsatisfied with the Town’s response, Mr. Pecevich appealed, and this case was opened as a result. Current Appeal In his appeal petition and subsequent email to this office, Mr. Pecevich contends that “files that [he has] received are incomplete and incongruent.” He further contends that “by this statement from the [Town’s] attorney - the window or time frame for a Response and fulfillment of [Mr. Pecevich’s] Request is left wide open.” Subsequently, in an email to Mr. Pecevich and this office on June 21, 2021, a representative of the Town provided Mr. Pecevich with additional records responsive to his request.
