The Commonwealth of Massachusetts William Francis Galvin, Secretary of the Commonwealth Public Records Division Rebecca S. Murray Supervisor of Records June 21, 2021 SPR21/1434 Seah Levy Public Records Access Officer City of Cambridge 795 Massachusetts Avenue Cambridge, MA 02139 Dear Ms. Levy: I have received the petition of Attorney Peter Hahn and Stewart Craig appealing the response of the City of Cambridge (City) to a request for public records. G. L. c. 66, § 10A; see also 950 C.M.R. 32.08(1). On May 20, 2020, Peter Hahn requested 16 categories of records pertaining to King Open School, including several categories of records relating to the principal. Previous determination The requested records were the subject of a previous determination. See SPR20/0891 Determination of the Supervisor of Records (June 11, 2020). In my June 11th determination, I found the City had established good cause for a time extension of 30 business days. Further, I found the City had met its burden to explain how the response could not be prudently completed without redaction or segregation. On February 10, 2021, Attorney Hahn and Mr. Craig submitted a narrowed request for a portion of the request and provided payment to the City for the records. Claiming to not yet have received responsive records, Attorney Hahn and Stewart Craig petitioned this office and SPR21/1434 was opened as a result. Conclusion Subsequent to the opening of this appeal, the City provided a response on June 15, 2021, stating “[t]he City of Cambridge has your response underway and is attempting to produce it to you as quickly as possible.” Where City indicates they are working on producing the responsive records, I will now consider this administrative appeal closed. To the extent possible, the City One Ashburton Place, Room 1719, Boston, Massachusetts 02108 • (617) 727-2832• Fax: (617) 727-5914 sec.state.ma.us/pre • pre@sec.state.ma.us Seah Levy SPR21/1434 Page 2 June 21, 2021 must provide responsive records on a rolling basis. If issues remain unresolved, Attorney Hahn and Mr. Craig may appeal the substantive nature of the City’s response within ninety (90) days. See 950 C.M.R. 32.08(1). Sincerely, Rebecca S. Murray Supervisor of Records cc: Peter Hahn, Esq. Stewart Craig
